Divorce or separation is an emotionally draining process. In order to protect yourself and your legal rights, you need to hire an attorney who is experienced with the laws of Pennsylvania regarding divorce, alimony, and spousal/child support. Pennsylvania divorce laws are complex as they permit a divorce to be entered without the “fault” of either, which is commonly referred to as a no-fault divorce. However, Pennsylvania still permits parties to obtain a divorce if they prove that the other party engaged in certain and specific conduct that the law has designated as constituting a “fault,” such as adultery or bigamy. In addition to obtaining a divorce, you also will be confronted with issues regarding the distribution of marital property. Determining what constitutes marital property, and even marital debt, is a highly nuanced aspect in the law. Equitable Distribution is the process where the court determines what property is subject to distribution and which spouse gets what property, which can include pension benefits, retirement accounts, the marital residence, and vehicles. Certain debt obligations may also be included in this calculation.
